Usage of these properties occurs within the limits of Turkish Civil Code. Differently from the previous Turkish Civil Code, parents just have a right of usage the child properties, right to benefit from properties is not vested. This regulation, that is brought to Turkish Civil Code, is also in accordance with the 32th article of UN Convention on the Rights of the Child. Parents’ right to manage of child’s properties is not limitless. They are liable like an attorney while they perform this power. Hence, if it is determined that they behave without required loyalty and care, judge takes necessary measures against parents respecting the management of properties. When it is understood by the judge that measures taken are not sufficient in order to protect child’s properties management of properties is taken from parents and entrusted to a trustee.
