Bu noktada ücreti ödenmeyen işçi, işverene karşı dava veya takip yoluna başvurarak ücretin ödenmesini talep edebilecektir. Ancak işçiye sağlanan haklar ücretin talebi ile sınırlı değildir. İşverenin, işçinin ücretini ödememesi halinde işçi, iş sözleşmesini haklı nedenle feshedebileceği gibi, çalışmaktan kaçınma hakkını da kullanabilecektir. Yine işçi, işverenin malları üzerinde yasal koşulları oluştuğu takdirde hapis hakkını da kullanma imkânına sahip olacaktır.The wage that has the role of being the only income for he labourer and his/her family gives it a "reliant of life" importance. By the virtue of this importance, many legal regulations have been made both in Constitution and Labour Law in relation to wage protection. At this point, unpaid employee will be able to demand to get paid by suing against the employer or applying for legal pursue. However, the rights of labourer aren't restricted with the wage claims. In the case of still not being paid, the labourer can also cancel the work contract or using the right to refrain from working.
