Çalışmamızın ilk bölümünde, uluslararası hukukta geçici koruma statüsü incelenmiştir. Bu kapsamda geçici korumanın tanımı, unsurları, geri göndermeme ilkesi ve asgari muamele standardı ele alınmıştır. Bunun akabinde Türk hukukunda geçici koruma statüsünün ne olduğu, geçici korumanın tanımı, kişi bakımından kapsamı, geçici korumanın sona ermesi, geçici koruma statüsü sahibi yabancılara sağlanan hizmetler ve geçici korumanın sona ermesi halinde kalıcı çözümlerin neler olduğu incelenmiştir. İkinci bölümünde geçici koruma statüsünde bulunan yabancıların çalışma hakları ve bu çalışma hakkını kullanmaları için gerekli şartlar ile usul ve esaslar belirtilerek açıklanmıştır. Çalışmamızın son bölümünde ise yabancıların sosyal güvenlik hakkı ile geçici koruma altındaki yabancıların sosyal güvenlik hakkı ve sigortalılık durumları hem mevzuat hem de uygulama açısından değerlendirme konusu yapılmıştır.The aim of this study is to examine the temporary protection status and the employment and social security rights of foreigners who have temporary protection status in Turkish law. In the first part of our study, temporary protection status in international law has been examined. In this context, the definition of temporary protection, its elements, the principle of non-refoulement and the minimum treatment standard are discussed. After that, what the temporary protection status is in Turkish law, the definition of temporary protection, its scope in terms of person, the termination of temporary protection, the services provided to foreigners with temporary protection status and the permanent solutions in case of termination of temporary protection are examined. In the second part, the working rights of foreigners under temporary protection status and the necessary conditions, procedures and principles for using this right are explained.
