Avrupa Birliği ülkelerinde demokrasi, iyi yönetim, hukukun üstünlüğü, insan hakları ve temel özgürlüklerin geliştirilip güçlendirilmesinde önemli role sahip Ombudsmanlık kurumunun (KDK), Türkiye'de kendinden beklenen rolü oynayabilmesi için bilinirlik, bağımsızlık, tarafsızlık ve şeffaflık gibi özelliklere sahip olması gerektiği Avrupa Birliği'nin Türkiye'ye yönelik çeşitli raporlarında ifade edilmektedir. Tezin temel amacı, KDK'nın çağdaş anlamda bir ombudsmanlık kurumuna dönüşmesi konusunda Avrupa Birliği'nin öneri, görüş ve eleştirilerinin neler olduğunu, KDK'nın kurumsal yapılanmasında ve işleyişinde bu önerilerin ve Venedik Komisyonu İlkeleri'nin ne kadarının dikkate alınıp hayata geçirildiğini ortaya koymaktır. Tezde AB'nin söz konusu görüş ve önerileri başlıklar halinde açıklanmakta, her bir başlık altında AB'nin Türkiye'den beklentileri ve KDK'nın bunların ne kadarını karşılayabildiği ortaya konulmaktadırThe Ombudsman Institution, which aims to solve the problems of citizens and eliminate their grievances by listening and investigating the complaints of the citizens againts the rulers, emerged in Sweden in the 18th century and started to spread to other countries of the world two centuries later and was established in all European Union member countries as well as European Union candidate countries. The Ombudsman Institution was established in Turkey under the name of Ombudsman Institution (KDK) in 2012 with the law numbered 6328, with the encouragement and guidance of the European Union. The Ombudsman Institution (KDK), which has an important role in the development and strengthening of democracy, good governance, rule of law, human rights and fundamental freedoms in European Union countries must have characteristics such as awareness, indepentence impartiality and transparency in order to play the role expected from it in Turkey. It is expressed in EU's various reports about Turkey. The main purpose of the thesis is to reveal the suggestions, opinions and criticisms of the European Union on the transformation of the into an ombudsman institution in the contemporary sense and, to what extent these suggestions, and the Venice Commission Principles, were taken into account and implemented in the institutional structuring and functioning of the OIC.
