Temel hak ve özgür!ük!erin teminatı ve demokratik hukuk devletinin önkoşulu olan bağımsız ve tarafsız yargının kurucu unsurlarından olan savunmayı temsil eden avukatlar, adaletin tecellisine katkıda bulunmak suretiyle toplumsal barışın korunmasına ve devamına hizmet ederek çok önemli ve kutsal bir görev icra etmektedirler. Bireylerin haklan kadar, hukukun üstünlüğüne dayalı çağdaş demokrasinin de her zaman yılmaz savunucuları olan avukatlar ve barolarımız; Yargı Reformu Stratejisi'nde acaba ne düzeyde ele alınmıştır? Hükümetin, güven veren ve çağdaş bir adalet sistemi oluşturma amacıyla öne çıkardığı Yargı Reformu Stratejisi'nin, bu amaca avukatlar ve barolar açısından ne kadar yaklaştığı ve onlar açısından ne kadar olumlu nitelikler içerdiği bu çalışmamızda tartışılmıştır.

What the notion of «civil rights and obligations» includes, which is put into words within the framework of the article 6 of the European Convention on Human Rights, offers a great importance in the application for both on one side -the ones who apply the European Court of Human Rights and the other- the European Court of Human Rights which adjudicates the applications done. For this specific consideration, what the civil rights and obligations are and what they include need to be bound, defined and known. In this study, in the light of the views in doctrine and the caselaw (jurisprudence) of the European Court of Human Rights, the notion of «civil rights and obligations» is assessed by reviewing and handled one by one according to the proceedings.
