Destekten yoksun kalma tazminatı

Ülkemizde meydana gelen birçok trafik kazası, iş kazası, taksirle ya da kasten öldürme olayları sebebi ile ölen kişinin bakımını üstlendiği ya da gelecekte muhtemel olarak üstleneceği kişi ya da kişiler, maddi ve manevi zarara uğramaktadır. Çalışmanın konusunu oluşturan destekten yoksun kalma tazminatı, desteğini yitiren kişilerin uğradıkları zararların tazminini amaçlayan bir tazminat türüdür. Dolaylı ve maddi bir zarar olan destekten yoksun kalma tazminatı, desteğini yitiren kişilere, Türk Borçlar Kanunu'nda yer alan özel hükümle zararın giderimi için talep imkânı tanımıştır. Bu anlamda, tazminata hak kazanılması için gereken şartların neler olduğu, zararın hangi koşullarda oluştuğu, yardım ve hizmet edimlerinden nelerin anlaşılması gerektiği, belirlenen zarardan hangi hususların indirim konusu yapılacağı, destek ilişkisinde göz önünde bulundurulacak hususların neler olduğu, doktrin ve yüksek yargının görüşleri doğrultusunda açıklanması ve uygulama birliğine varılması gereken önemli hususlardır.

The person or persons who have taken care of the deceased or who will possibly undertake in the future due to many traffic accidents, occupational accidents, negligent or deliberate killing in our country suffer material and moral damage. The compensation for deprivation of support, which is the subject of the study, is a type of compensation that aims to compensate the damages suffered by those who lose their support. Compensation for deprivation of support, which is an indirect and material damage, has given the people who lost their support the opportunity to demand the compensation of the damage with a special provision in the Turkish Code of Obligations. In this sense, explaining what the conditions are required to be entitled to compensation, under what conditions the damage occurs, what should be understood from the aid and service actions, which issues to be deducted from the determined damage, what are the points to be considered in the support relationship, in accordance with the doctrine and the opinions of the high judiciary, and implementation unity are important issues to be reached.
