Uluslararası hukukta mülteci ve sığınmacıların eğitim hakkı

1951 tarihli Mültecilerin Hukuki Durumuna Dair Cenevre Sözleşmesine göre mülteci; ırk, din, tabiiyet, belli sosyal gruba mensubiyet veya politik düşünce sebebiyle zulme uğrayacağından korktuğu için vatandaşı olduğu ülkeyi terk eden kişi olarak tanımlanmaktadır. Sığınmacı ise yetkili makamlarca sığınma talebi henüz sonuçlanmamış kişidir. 1951 Cenevre Sözleşmesine ek olarak diğer pek çok insan hakları sözleşmeleri mülteci ve sığınmacıların haklarını ortaya koymada kaynaklık etmektedir. Bu haklar arasında eğitim hakkı, bireyleri dönüştürücü ve güçlendirici, kendi kendine yetebilmeyi sağlayıcı bir hak olarak ön plana çıkmaktadır. Bu tez çalışmasında da mülteci ve sığınmacılar için hayati önem taşıyan eğitim hakkı uluslararası insan hakları düzenlemeleri doğrultusunda incelenmiştir. Tez kapsamında mülteci hukukunda yer alan ancak uygulamada birbiri yerine kullanılan kavramlar açıklanmış, mülteci hukukunun tarihsel gelişimine yer verilmiştir. İkinci bölümde eğitim hakkının mülteci ve sığınmacılar açısından önemi ve hakkın yer aldığı insan hakları belgeleri irdelenmiştir. Son olarak eğitim hakkı ile ilgili Avrupa İnsan Hakları Mahkemesi kararları ışığında mülteci ve sığınmacıların eğitim hakkı incelenmeye çalışılmıştır.

According to the 1951 Geneva Convention Relating to the Status of Refugees, a refugee; is defined as a person who leaves the country of his citizenship because he fears that he will be persecuted because of race, religion, nationality, membership of a certain social group or political opinion. While an asylum seeker is a person whose asylum request has not yet been concluded by the competent authorities. Many other human rights instruments, in addition to the 1951 Geneva Convention, sets forth the rights of refugees and asylum seekers. Among these rights, the right to education stands out as a right that transforms and empowers individuals and ensures self-sufficiency. The right to education, which is crucial for refugees and asylum seekers, has been examined in this thesis in light of international human rights instruments. Within the scope of the thesis, the misused concepts in practice in refugee law are explained and the historical development of refugee law is laid out. In the second part, the importance of the right to education for refugees and asylum seekers and the human rights documents that include the right examined. Finally, the right to education of refugees and asylum seekers has been examined in the light of the European Court of Human Rights Decisions.
