Din İşleri Yüksek Kurulunun faizsiz finans uygulamalarına yaklaşımı

Çalışmamız, Diyanet İşleri Başkanlığı bünyesinde kurulan, Din İşleri Yüksek Kurulunun faizsiz finans uygulamaları hakkındaki görüşlerini tespit etmek, değerlendirmek ve müstakil bir eserde toplayarak literatüre kazandırmak amacıyla hazırlanmıştır. Çalışmada, herhangi bir eserde toplanmamış dağınık olan fetvalar ve kararlar, konular kapsamında kategorize edilerek bir araya getirilmeye gayret gösterilmiştir. Çalışmamız, iki bölüm şeklinde oluşturulmuştur. İlk bölümde, Diyanet İşleri Başkanlığı ve Din İşleri Yüksek Kurulunu tanıtacak bilgilere yer verilmiştir. İkinci bölümde ise Kurulun fetvaları farklı başlıklar altında kategorize edilerek ele alınmış, yalnızca fetvaların zikredilmesiyle yetinilmeyip, öncesinde konuyu izah etmek amacıyla meselenin genel hatlarına değinilmiş, akabinde fetvalara yer verilmiştir. Çalışma yapılırken nitel araştırma yöntemi kullanılmış, yetkili kişilerle görüşülmüş ve doküman analizi yapılarak veriler toplanmıştır. Kurulun genel itibarıyla faizsiz finans meseleleriyle ilgili çalışmalar yaptığı ve söz konusu meselelerle yakından ilgilendiği tespit edilmiştir. Akabinde ise elde edilen verilerden hareketle Kurulun, söz konusu meseleler hakkında, halkı çeşitli platformlardan bilgilendirdiği görülmüştür. Ancak resmî, yazılı, halka açık ve televizyon programlarındaki fetvaların bazılarının yeterli, açık, detaylı olmadığı ve bir kısmının da güncel ihtiyacı tam anlamıyla karşılayamadığı kanaatine ulaşılmıştır.

The thesis in question has been prepared in order to identify and evaluate the views of the High Council of Religious Affairs, established under the Presidency of Religious Affairs, on interest-free finance practices, and to collect them in a separate work and bring them to the literature. In the study, an effort was made to bring together the scattered fatwas and decisions that were not collected in any work, by categorizing them within the scope of the subjects. The aforementioned study consists of two parts, and in the first part, information about the Presidency of Religious Affairs and the Supreme Council of Religious Affairs is given. In the second part, the fatwas of the Council were categorized and discussed under different headings, not only the fatwas were mentioned, but also the general outlines of the issue were mentioned in order to explain the issue beforehand, and then the fatwa was included. While conducting the study, qualitative research method was used and applied, interviewed with authorized persons and data were collected through document analysis. It has been determined that the Board generally works on interest-free finance issues and is closely interested in these issues. Subsequently, based on the data obtained, it was seen that the Board informed the public about the aforementioned issues from various platforms. However, it has been concluded that some of the fatwas in official, written, public and television programs are not sufficient, clear and detailed, and some of them do not fully meet the some needs.
