İzmir İl Müftülüğü fetva hattına gelen talâkla ilgili soruların İslam hukuku açısından tahlili

İnsanoğlunun huzurlu, mutlu, sıcak bir yuva kurması ve neslinin devam etmesi için evlenmesi İslam dinine göre meşru bir yol, Hz. Peygamber (s.a.v)'in en önemli sünnetlerindendir. Bunun içindir ki İslam toplumları evlenmeye büyük önem vermişler ve aileyi önemli bir kurum olarak kabul etmişlerdir. Ailenin sağlam temeller üzerine inşa edilmesi ve sağlam nesiller yetiştirilmesi İslam'ın önem verdiği meselelerdendir. İslam aile hukuku evlilik öncesi nişanlılık dönemi, nikâh, talâk (boşama) ve evliliğin sonuçları gibi bölümlerden oluşmaktadır. Çalışmamız da İzmir İl Müftülüğü fetva hattına gelen talâk ile ilgili soruları tahlil ettik. Soruların ihtiva ettiği konuları ve kavramları işledikten sonra her bir konuyu İslam hukuku kaynaklarından inceleyerek tahlil ettik.

According to the religion of Islam, marriage is a legitimate way for human beings to establish a peaceful, happy, warm home and to continue their lineage. It is one of the most important sunnahs of the Prophet (saas). For this reason, Islamic societies have given great importance to marriage and have accepted the family as an important institution. The place of the family in Islam is very important. Building the family on solid foundations and raising strong generations are among the issues that Islam attaches importance to. Islamic family law consists of parts such as the engagement period before marriage, marriage, talaq (divorce) and the consequences of marriage. In our study, we analyzed the questions about the talaq that came to the Izmir Provincial Mufti fatwa line. After processing the subjects and concepts contained in the questions, we analyzed each subject by examining the sources of Islamic law.
