Şâfiî mezhebine göre bağy

Bağy (isyan) İslâm fıkhında siyasi suçlar kategorisinde kabul edilen bir suç çeşididir. Bağy suçu meşru devlet başkanına karşı bir başkaldırıdır. Bu fiil ile siyasi iktidarın zayıflatılması, yıkılması veyahut da değiştirilmesi amaçlanmakta ve bu doğrultuda siyasi iktidara karşı güç kullanılarak istenilen hedefe ulaşılmak istenmektedir. İslâm Fıkhında bu fiilin cezası ağır olmakla birlikte devletin düzenini değiştirmeyi hedeflemeyen, ona karşı ayaklanmaya girişmeden veya çatışmalara sebebiyet vermeden sözlü olarak devlet başkanının yanlışlarını söylemek ve eleştiride bulunmak "bağy" suçuna dâhil edilmez. Bir fiilin bağy suçuna dâhil edilebilmesi için devlete karşı güç kullanarak yönetimi değiştirmeyi veya devleti yıkmayı hedeflemesi gerekmektedir. Tez çalışmamız, Şâfiî mezhebine göre bağy ahkâmını ele almakla beraber, diğer Sünni mezheplerin bağy ile ilgili görüşlerine de yer verilmiştir. Bu bağlamda birinci bölümünde, üç mezhebin bağy hakkındaki görüşleri incelenmiştir. İkinci bölümde ise, Şâfiî Mezhebinde bağy konusu tüm detaylarıyla birlikte sunulmuştur. Bu bölüm dört temel başlık altında değerlendirilmiştir. Bunlar; "Genel Olarak Bağy", "Bağy Mensuplarına Karşı Yapılan Savaş Ahkâmı," "Bağy mensuplarıyla İlgili Mal ve Can Ahkâmı" ve "Bağy Mensuplarıyla İlgili Esir ve Cenaze Ahkâmı" konularıdır. Bagy (rebellion) is a type of crime accepted in the category of political crimes in Islamic jurisprudence. Bagy crime is a rebellion against the legitimate head of state. With this action, it is aimed to weaken, destroy or change the political power, and in this direction, the desired goal is to be achieved by using force against the political power. Although the punishment for this act is severe in Islamic Jurisprudence, verbally speaking about the mistakes of the head of state and criticizing him without aiming to change the order of the state, without attempting to revolt against him or causing conflicts is not included in the crime of "bagy". In order for an act to be included in the crime of bagy, it must aim to change the administration or destroy the state by using force against the state. Although our thesis study deals with the rules of bagy according to the Shafii sect, the views of other Sunni sects regarding bagy are also included. In this context, in the first part, the views of three sects about bagy were examined. In the second chapter, the subject of bagy in the Shafi'i Sect is presented with all its details. This section has been evaluated under four main headings. These subjects are "Bağy in General", "War Regulations Against Bagy Members", "Property and Life Regulations Regarding Bagy Members" and "Prisoner and Funeral Regulations Regarding Bagy Members".
