EVALUATIONS ON REGARDING THE AMENDMENTS MADE BY THE LAW NUMBERED 7339 IN THE COOPERATIVES LAW AND THE OTHER LAWS

Unlike other commercial companies, the main regulations regard-\ring cooperatives, which are accepted as one of the commercial compa-\rnies in Article 124/1 of the Turkish Commercial Code numbered 6102\r(TCC), are not regulated in the TCC, but are inherently regulated in the\rCooperatives Law numbered 1163 and dated 1969 (CL). It can be seen\rthat since the moment it came into force, some changes that are primari-\rly substantive, has been made so far in the CL. However, contrary to the\rexpectation of the public on the CL, which based on the idea of regulat-\ring cooperatives under a new law by abolishing the existing CL, policy-\rmakers preferred to make the necessary changes in the CL in order to\rsolve the current problems of cooperatives instead of making a fresh\rCooperatives Law. The most recent amendment in the CL has been made\rwith the Law numbered 7339, which entered in force on 26th of October\r2021. In this respect, the leading aims of this study are to determine the\ramendments made by the Law numbered 7339 on the CL and some other\rLaws, to evaluate the appropriateness of these new regulations and to\roffer some solutions for the potential problems.
