Margin of Appreciation in The Decisions of the ECHR on Freedom of Expression About Turkey

The margin of appreciation is a doctrine that is not envisaged by the ECHR but is accepted in order to meet some needs in practice. The importance of the margin of appreciation is seen in establishing a balance between the understanding of sovereignty, which is thought not to be limited in any way until the 20th century, and the attempt to limit the sovereignty of states through an international control mechanism. The aim of the study is to determine the place of the margin of appreciation in the decisions made by the ECtHR regarding freedom of expression in Turkey by establishing a general opinion about the development, aims and scope of the concept. In the decisions of the court concerning freedom of expression concerning Turkey, determining the limits of the area of discretion granted to the state is important in terms of determining the scope and limits of the jurisdiction of the state regarding the limitation of freedom of expression, as well as the freedom of expression of individuals.
