    Concerned person in notary proceedings

    Uyumaz, Murat

In the article 72/2 of Turkish Code of Notary Public (Numbered 1512, Dated 18.01.1972), “concerned person” is defined as the person who requests certification from the notary public. However, notaries public have some other duties that are different from the certification. In notary transactions, identification of the concerned person is important in terms of the determination of legal responsibility, prohibitions, competence of concerned person and the genuine will of concerned person. In addition, Turkish Code of Notary Public includes some regulations regarding the special circumstances of the concerned person. On the other hand, in the Turkish Code of Notary Public, notaries public are assigned in the process of issuing a certificate of inheritance and inviting the leaving spouse to the common residence. In this case, the concepts of “concerned person in notary proceedings” and “concerned person in non-contentious judicial proceedings” become interrelated.
